HOUSE RULES for Attending Events at the ALICE Rooftop Venue

**Regulates the Rights and Duties of Visitors During Their Stay at the ALICE Rooftop Venue for Events of Any Kind**

    1 Access and stay

    1.1 Scope and House Rules

    These house rules apply to all rooms and within the boundaries of the outdoor facilities of the ALICE Rooftop event location. The house rules apply on all event days and on other days for all employees, users and their staff, as well as visitors and any other persons, regardless of the reason for their presence at the ALICE Rooftop event location. Violations of the house rules can result in immediate expulsion, exclusion from the event, or in severe cases, a permanent ban.

    1.2 House Rules as Part of the Visitor Contract

    The house rules for visitors are an integral part of the visitor contract between the respective event organizer and their visitors at the ALICE Rooftop event location. If Alice Roof Top GmbH rents out its premises to an external organizer, these house rules for visitors are also an integral part of the rental contract between Alice Roof Top GmbH and the respective tenant/external organizer.

    1.3 Admission Ticket/Guest Invitation

    Access to and stay in the event location before, during, and after the event duration is only permitted with a valid admission ticket or guest invitation. This becomes invalid upon leaving the event location. Only the designated visitor entrances may be used.

    1.4 Admission Control and Prohibited Items

    Dangerous and prohibited items, as well as beverages, are not allowed to be brought in. Depending on the nature of the event, bringing bags and similar containers into the event may also be prohibited. Admission controls are in place. The admission staff is authorized to take custody of items belonging to visitors to ensure order and security before allowing entry to the event. Bags, containers, and clothing, such as coats, jackets, and capes, may be inspected for their contents. Visitors who do not agree to the inspection or confiscation of items that could pose a risk to the event or other visitors will not be allowed in or will be excluded from the event. Persons visibly under the influence of alcohol or drugs or displaying aggressive behavior will be denied entry or removed from the event.

    1.5 Unconstitutional Content

    Alice Roof Top GmbH condemns events with extremist, racist, or anti-democratic content. Neither the freedom and dignity of the individual may be denigrated in word or writing, nor may symbols representing unconstitutional organizations be used or disseminated. Persons carrying items with unconstitutional symbols may be denied entry or the items may be taken into custody.

    1.6 Minors

    Security personnel may deny entry to children and adolescents under 18 years old after 11 PM if they are not accompanied by a legal guardian or an adult supervisor with prior written consent from the legal guardians. Both the minor and the accompanying person must carry an ID card as well as a copy of the legal guardian’s ID card. The ID card may be replaced by an equivalent identification document. Failure to comply with these requirements will result in denied entry.

    2. Orders of Security Personnel, Enforcement of House Ban

    2.1 Orders of Security Personnel

    The responsible employees of the operator/tenant/organizer must carry out the necessary security and order tasks in accordance with the general event conditions of Alice Roof Top GmbH; their instructions must be followed.

    2.2 Imposition and Duration of House Ban

    Anyone who violates these house rules can be expelled from the building and grounds of the ALICE Rooftop event location. This applies to all current and future events held at the ALICE Rooftop event location. The operator will decide on the lifting of the house ban upon request at its reasonable discretion.

    2.3 Expulsion from the Event Location

    Alice Roof Top GmbH/the tenant/the organizer can expel visitors from the event location if they violate the house rules or significantly disrupt the event. These visitors have no right to a refund of the admission fee or other compensation for damages and expenses. In accordance with section 1.5, persons using or disseminating extremist, racist, or anti-democratic content will be excluded from the event.

    3. Conduct in the Building and on the Premises

    3.1 Principle of Careful Use

    All facilities of the ALICE Rooftop event location must be used with care. Visitors can be held liable for any damage caused intentionally or negligently. Excessive noise in the premises and on the grounds of the ALICE Rooftop event location should be avoided to protect residents.

    3.2 Unauthorized areas

    Visitors are prohibited from entering rooms and areas not approved for visitor traffic, including technical operating rooms. Security personnel can redefine unauthorized rooms and areas during ongoing events to ensure safety and order. Specifically, the terrace may be closed and declared off-limits to visitors from 10 PM onwards. Visitors must leave the terrace when requested by the operator/tenant/organizer.

    3.3 Volume Limitation

    Music playback devices of the operator are calibrated and officially approved. Volume adjustment is not possible. Therefore, an indoor sound pressure level of 90 dBA and an outdoor sound pressure level of 45 dBA must be observed.

    3.4 Unauthorized Actions

    It is not allowed to unfurl banners or distribute information material unless authorized for distribution.

    3.5 Bringing Animals

    Bringing animals, except for guide dogs for the blind, is not allowed.

    3.6 Fog Machines, Helium Balloons, Confetti

    The use of fog machines and helium balloons can disrupt the event by triggering the sprinkler system and incurring high costs due to automatic fire brigade alerts and is therefore prohibited. The use of confetti is also not allowed due to the high cleaning effort required. If these items are used, the tenant is liable to the operator for any resulting damages according to the general terms and conditions.

    4. Smoking Ban

    4.1 General Smoking Ban

    Smoking is generally prohibited in all rooms of the ALICE Rooftop event location, including electronic cigarettes ("e-cigarettes"). Smoking is only permitted on the outdoor terrace. If smoking violations are detected, Alice Roof Top GmbH/the tenant/the organizer will take necessary and reasonable measures to prevent further violations (see section 2 for house bans and expulsions).

    4.2 Cannabis Consumption

    Cannabis consumption is prohibited throughout the entire ALICE Rooftop premises, including the outdoor terrace. In case of violations, the provisions of section 1 apply accordingly.

    5. Mutual Consideration

    Within the ALICE Rooftop event location, everyone must behave in a way that does not harm, endanger, or unreasonably obstruct or inconvenience others. Visitors are expected to show mutual consideration in the interest of maintaining order.

    6. Closure and Evacuation

    For safety reasons, the closure of rooms and open spaces and their evacuation can be ordered by Alice Roof Top GmbH/the tenant/the organizer. All persons present at the ALICE Rooftop event location and on the premises must immediately follow the instructions of the authorized security personnel, police, and fire brigade and leave the event location promptly in case of an evacuation order. They must ensure no harm comes to third parties in the process.

    7. Prohibited Items

    7.1 List of Prohibited Items

    The following items are particularly prohibited:

    - Weapons or dangerous objects, and items that, when thrown, can cause bodily harm;
    - Gas spray cans, corrosive or staining substances, or pressure containers for flammable or harmful gases, except for standard pocket lighters;
    - Containers made of breakable or splintering materials, especially glass, glass products, and bottles;
    - Bulky items like ladders, stools, chairs, crates;
    - Fireworks, rockets, flares, smoke powder, light balls, and other pyrotechnic items, as well as sparklers;
    - Flags or banner poles that are not made of wood, are longer than 2 meters, or have a diameter greater than 3 cm;
    - Large-scale banners, large amounts of paper, wallpaper rolls;
    - Mechanically and electrically operated noise instruments;
    - All beverages, food, and drugs;
    - Racist, xenophobic, and radical propaganda material;
    - Video cameras or other audio or video recording devices for commercial use (unless the organizer has given explicit permission).

    7.2 Additional Items

    Alice Roof Top GmbH may prohibit the carrying of additional items not listed under 7.1 based on the type of event and to prevent safety and order hazards at any time.

    8. Ban on Commercial Activities

    8.1 Advertising or Selling Goods

    Advertising or selling goods, organizing collective orders, and conducting collections are prohibited at the ALICE Rooftop event location without prior written consent.

    8.2 Prohibition on Bringing Items for Commercial Purposes

    Visitors are prohibited from bringing any items onto the ALICE Rooftop event location with the intent to sell them or use them for commercial purposes. Items brought for these purposes or actually offered for sale can be removed or held in custody by security personnel and other authorized persons until the end of the event.

    8.3 Artistic Performances

    Visitors are also prohibited from performing musical or artistic acts or other unauthorized performances and displays directed at multiple persons on the ALICE Rooftop premises.

    8.4 Violations

    In the event of culpable violations of sections 8.2 and 8.3, a contractual penalty of 1,000 euros will become immediately due; further claims are expressly reserved by Alice Roof Top GmbH. In the case of section 8.2, this claim applies only to the actual offer for sale.

    9. Photo and Audio-Visual Recordings, Media

    Visitors are not allowed to bring professional photo and film equipment and corresponding equipment that suggest commercial use to the event. Photo and video recordings made at the event location may only be used for private purposes. Any commercial use of the photo and video recordings is prohibited.

    10. Lost Property

    Lost property must be handed over to the employees of Alice Roof Top GmbH/the tenant/the organizer. No liability is assumed for lost property.

    11. Personal and/or Property Damage

    Personal and/or property damage must bereported immediately to the employees of Alice Roof Top GmbH/the tenant/the organizer. Damage reported later will not be recognized.

    12. Alarm

    In the event of an alarm, instructions from Alice Roof Top GmbH/the tenant/the organizer's staff must be followed without fail.

    13. Other Regulations

    For service providers of Alice Roof Top GmbH, especially caterers, live musicians, and DJs, the relevant memos of Alice Roof Top GmbH, which are sent to the respective service providers in connection with the assignment via email, are also binding.
